Do I Need a Permit to Finish a Basement in Illinois?

Who decides: the municipality, not the state
The Capital Development Board puts it plainly:
“Currently there is no statewide building code. Units of local government can adopt codes of their choice. However, effective 1/1/2025 a statewide building code will go into effect as required by the Capital Development Board Act.”
That statement is the reason the answer changes by address. A statewide baseline has applied since January 1, 2025 (Public Act 103-0510): any local code must regulate structural design at least as strictly as the International Residential Code and its siblings published in the current year or the nine years before. The baseline sets a floor. Each city, village and county still adopts its own code and runs its own permit office. So the first question is never “does Illinois require a permit” but “who issues permits at my address.”
Rockford
The City of Rockford requires a permit for the “construction, alteration, enlargement, repair, or moving of a structure larger than 120 square feet.” A basement finish is an alteration of the whole structure, and a basement is nearly always bigger than 120 square feet, so it needs a permit. The exemptions are finish work: painting, papering, tiling, carpeting, cabinets and counter tops. Replacing wall or ceiling coverings is also exempt when 50% or less of the coverings in a room are removed and no framing is exposed to the point where hardwired smoke alarms become required. Framing a new wall, running new circuits or adding a bathroom is outside every one of those exemptions. The city's remodel application even has separate lines for finished and unfinished basement square footage, so the office expects basement finishes to come through it (City of Rockford, Building Permits).
Outside Rockford
Loves Park says permits cover “all new buildings, structural changes, remodeling projects, electrical, mechanical, and plumbing work” and that “Permits are needed for anything that requires inspections” (City of Loves Park, Building Permits FAQ). Machesney Park lists residential additions and alterations, and any plumbing, HVAC or electrical work, as requiring a permit (Village of Machesney Park, Permits and Fees). Winnebago County Code Chapter 18 makes it unlawful to alter a structure without a permit, and the county Building Division issues them for unincorporated areas and for Cherry Valley, Durand, New Milford, Rockton, Roscoe and South Beloit (Winnebago County, Building Division). The full list, town by town, is in the permit office guide and on each service area page.
One finish, several permits
A basement finish is rarely one permit. The building permit covers framing and the finished space, and electrical, plumbing and mechanical work are permitted as trades. Rockford issues each trade permit under the building permit and its fee schedule lists a separate charge for each; Winnebago County charges its processing fee per trade. Plumbing has its own state rule on who may pull the permit; see the basement bathroom permit guide. Fee figures are on the fee guide.
What to do before you frame
- Find the office that covers your address (a Rockford mailing address can sit in another municipality).
- Ask what the office wants in the drawing: a layout with room names, egress openings and the electrical plan.
- Ask which code edition and which local amendments the reviewer will use.
- Ask how far ahead to request each inspection. Rockford asks for one full business day (24 hours).

Quick answers
Does a finished basement need a permit in Illinois?
Illinois leaves permits to each city, village and county. Rockford, Loves Park, Machesney Park and Winnebago County all require one for remodeling work that adds walls, electrical or plumbing. Confirm the rule for your address with its permit office before you start.
What basement work does not need a permit in Rockford?
Painting, papering, tiling, carpeting, cabinets and counter tops are exempt. So is replacing wall or ceiling coverings when half or less of the coverings in a room come off and no framing is exposed.
Who issues the permit if I live outside Rockford?
It depends on the municipality. Loves Park and Machesney Park run through the Loves Park Building Department, and Winnebago County issues for unincorporated areas plus six villages. Each service area page names the office.
Does the statewide code baseline change anything for my basement?
It sets a floor for structural design in local codes from January 1, 2025. Your own city or county still adopts its code and enforces it, so the permit office remains the authority on what it will inspect.
